These Terms of Service ("Terms") govern your access to and use of the MonkeysMail platform, API, dashboard, and related services (collectively, the "Service") provided by MonkeysCloud Corp. ("we", "us", or "MonkeysCloud"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using MonkeysMail, you represent that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your API keys and account credentials. You agree to notify us immediately of any unauthorized use of your account.

3. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited bulk email (spam) or messages that violate CAN-SPAM, GDPR, or similar regulations
  • Transmit malware, phishing content, or deceptive material
  • Harvest email addresses or personal data without consent
  • Impersonate any person or entity
  • Interfere with or disrupt the integrity of the Service
  • Exceed rate limits or circumvent usage restrictions
  • Resell or redistribute the Service without written authorization

We reserve the right to suspend or terminate accounts that violate this policy without notice.

4. Email Sending & Deliverability

MonkeysMail provides best-effort delivery. While we maintain a 99.9% delivery uptime SLA on paid plans, we cannot guarantee that every email will be delivered to the recipient's inbox. Deliverability depends on factors including sender reputation, recipient server configuration, and content quality.

5. Plans & Billing

The Service offers free and paid plans. Paid subscriptions are billed monthly or annually in advance. You may upgrade or downgrade at any time. Upgrades are prorated immediately; downgrades take effect at the next billing cycle. Prices are subject to change with 30 days' notice.

6. Data Ownership

You retain all rights to data you upload or transmit through the Service, including contact lists, email content, templates, and metadata. We do not sell, share, or use your data for purposes other than providing and improving the Service.

7. API Usage

Access to the MonkeysMail API is subject to rate limits and fair use policies. API keys are confidential and should be stored securely. We reserve the right to throttle or suspend API access for accounts that significantly exceed their plan limits or abuse the infrastructure.

8. Limitation of Liability

To the maximum extent permitted by law, MonkeysCloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

9. Termination

You may terminate your account at any time by contacting us or through the dashboard. We may terminate or suspend your access if you violate these Terms. Upon termination, your data will be retained for 30 days for recovery purposes, after which it will be permanently deleted.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the dashboard. Continued use of the Service after changes constitutes acceptance of the revised Terms.
